This website is provided solely to assist customers in gathering language course information, making legitimate reservations or otherwise transacting business with language service providers, and not for other purposes. Throughout the site, the terms "we", "us" and "our" refer to Australia Destination, a registered business in the city of Yagoona, Australia. Australia Destination provides this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions and notices stated here.

By browsing our site, you agree to the conditions and terms stated. These Terms and Conditions apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content. At our sole discretion, we reserve the right to update, change or replace any part of these Terms & Conditions by posting updates and changes to our website. Please check our website periodically for changes. Please read these Terms and Conditions carefully before accessing or using our website. You agree to be bound by these Terms and Conditions by accessing or using any part of the site. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any services.

The content and information on this website (including, but not limited to, price and availability of language travel services), as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers. While you can make copies of the information given to you or your documents, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products or services obtained from or through this website. Additionally, you agree not to:

• Use this Website or its contents for any commercial purpose

• Make any speculative, false, or fraudulent reservation

• Access, monitor or copy any content or information of this website using automated or manual means for any purpose without written permission from us

• Take any action that imposes, or may impose, at our discretion, an unreasonable or disproportionately large load of our infrastructure. 

• Frame, mirror or otherwise incorporate any part of this website into any other website without written permission from us

• Deep-link to any portion of this website for any purpose without written permission from us

Language school supplier rules and restrictions

You agree to abide by the Terms and Conditions of purchase imposed by any language school supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of products and services. 

Language course reservations

You agree that it is the responsibility of the language school supplier to provide you with the language course and tuition fee and that your contract is with the language school supplier. Australia Destination facilitates an introduction to the language school provider following our terms and conditions. You acknowledge that your place on any course is only confirmed once you have paid the instalment the language school supplier has imposed. 

You can cancel your booking before arrival according to the terms and conditions of the language school provider. You have to do so directly with the language school provider. Cancellations after deadlines in the terms and conditions of the language school provider may result in the loss of some fees paid. 

Reviews, comments and other submissions

Please be aware that by submitting content to this website by electronic mail, postings or otherwise, you grant Australia Destination and its affiliates a nonexclusive, royalty-free, perpetual, transferable, irrevocable and fully sublicensable right to (a) use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publically display and perform such submissions throughout the world in any media and (b) use the name that you submit in connection with such submission. You acknowledge and agree that submissions are non-confidential and non-proprietary. We do not take any responsibility and assume no liability for any submission posted or submitted by you. We do not have an obligation to post your comments or submissions. 

Liability Disclaimer

The information, products and services published on this website may include inaccuracies, including pricing errors. Australia Destination does not guarantee the accuracy of, and disclaims all liability for any errors or other inaccuracies relating to the information and description of the course and other products displayed on this website. Australia Destination expressly reserves the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price or the school changes the price.

 The language school providers and other providers are independent contractors. They are not agents or employees of Australia Destination. Australia Destination's affiliates are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Australia Destination has no liability and will make no refund in case of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control. They have no responsibility for any additional expense, omissions, delays or acts of any government or authority. 

In no event shall Australia Destination, Australia Destination's affiliates and/or its respective suppliers for any direct, indirect, punitive, incidental, special or consequential damages arising out of, or in any way connected with, your access to, display of, or use of this website or with the delay or inability to access, display or use this website. If, despite the limitation above, Australia Destination, its affiliates, or its suppliers are found liable for any loss or damage that arises out of or in any way connected with any of the occurrences described above, then Australia Destination, its affiliates and/or suppliers will in no event exceed, in the aggregate one-hundred Australian Dollars (AUD 100). 

Indemnification

You agree to defend and indemnify Australia Destination, Australia Destination's Affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

1. your breach of this Agreement or the documents referenced herein;

2. your violation of any law or the rights of a third party; or

3. your use of this Website.

Retention

If you have applied for an English course, we will keep your personal information for five years; after this period, we will delete your information from our systems.

 Australia Destination may update this privacy policy in the future. At our sole discretion, we reserve the right to update, change or replace any part of this Privacy Policy by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
